Terms of Service

1. Acceptance of Terms

By accessing or using TAXTEL.IE ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. We reserve the right to modify these terms at any time, and your continued use of the Service constitutes acceptance of any changes.

2. Description of Service

TAXTEL.IE provides vehicle import cost calculation tools, including estimates for customs duties, VAT, Vehicle Registration Tax (VRT), NOx levies, and freight costs. Our calculations are based on publicly available tax rates and regulations, but should be used for estimation purposes only.

3. Disclaimer of Accuracy

Important: The calculations provided by TAXTEL.IE are estimates only and should not be relied upon as definitive figures. Actual import costs may vary based on:

  • Changes in tax rates or regulations
  • Vehicle-specific factors not captured in our database
  • Currency exchange rate fluctuations
  • Additional fees charged by customs authorities, shipping companies, or other parties
  • Errors or omissions in our data

We strongly recommend consulting with a licensed customs broker or tax professional before making any purchasing decisions based on our estimates.

4. User Accounts

To access certain features of the Service, you may be required to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

5. Subscription and Payments

Paid subscriptions are billed in advance on a monthly or annual basis. All payments are processed securely through Stripe. By subscribing, you authorize us to charge your payment method for the subscription fee plus any applicable taxes.

Cancellation: You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of your current billing period. No refunds will be provided for partial billing periods, except as required by law.

Refund Policy: We offer a 14-day money-back guarantee for new subscribers. If you are not satisfied with the Service within the first 14 days of your subscription, contact us for a full refund.

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to the Service or its systems
  • Interfere with or disrupt the Service or servers
  • Scrape, harvest, or collect data from the Service without permission
  • Resell or redistribute the Service without authorization
  • Use automated systems to access the Service beyond normal API usage
  • Reverse engineer, decompile, or attempt to derive our calculation algorithms
  • Copy or reproduce our proprietary database or emissions data
  • Use the Service for competitive analysis or market research
  • Violate our rate limiting policies (see Section 6a below)

6a. Rate Limiting Policy

To protect our Service and ensure fair access for all users, we implement rate limiting:

  • Public Users: 100 requests per hour per IP address
  • Authenticated Users: 1,000 requests per day per account
  • API Users: Limits vary by subscription tier

Exceeding rate limits may result in temporary or permanent account suspension. Repeated violations may result in legal action.

Proprietary Content: Our vehicle emissions database, tax calculation algorithms, and multi-country tax rules are proprietary and confidential. You may not:

  • Copy, reproduce, or distribute our database or algorithms
  • Reverse engineer or attempt to derive our calculation methods
  • Create derivative works based on our Service
  • Use our data for competitive products or services
  • Redistribute our calculations or reports without attribution

Attribution: If you republish any calculations or reports from our Service, you must provide clear attribution to TAXTEL.IE (https://taxtel.ie).

Commercial Use: Commercial use of the Service requires a separate license agreement. Contact us for licensing inquiries.

8. Limitation of Liability

To the maximum extent permitted by law, TAXTEL.IE shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service.

Our total liability for any claims arising from your use of the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless TAXTEL.IE, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Ireland, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Ireland.

11. Enforcement

Violations of these Terms, particularly regarding intellectual property, rate limiting, or prohibited activities, may result in:

  • Immediate account termination
  • IP address blocking
  • Legal action and damages
  • Cooperation with law enforcement
  • Injunctive relief
